1) Accuracy of information and professional advice

• User data responsibility: Evervent relies entirely on the information provided by users, clients, and intermediaries to deliver its services. We cannot be held liable for any issues, errors, or consequences resulting from incomplete, inaccurate, or outdated information provided by you.
• Third-party content: Evervent expressly disclaims any responsibility or warranty regarding the accuracy, completeness, or correct sequence of content, services, or information provided by third parties, including insurers and external websites.
• No professional advice: While our platforms utilize machine learning and predictive analytics to help intermediaries make decisions, these are for informational purposes only and do not constitute financial or legal advice.

2) Technical limitations and service disruptions

• External factors: Evervent cannot guarantee uninterrupted access to its platforms at all times. We are not responsible for service failures or performance issues caused by factors beyond our control, including internet and network disruptions, technical failures of third-party service providers (e.g., hosting, payment gateways), and unauthorized access resulting from user negligence or account credential mismanagement.
• System vulnerabilities: While we implement industry-standard encryption and regular security audits, absolute security cannot be guaranteed for any digital service. Evervent is not liable for unforeseen security breaches caused by external threats.

3) Third-party services and integrated partners

• Partner deficiencies: Our services involve integration with various insurance carriers, Third-Party Administrators (TPAs), and payment processors. Evervent expressly disclaims any liability for deficiencies in services provided by these third parties, regardless of their affiliation with the company.
• External links and cookies: We are not responsible for the content, privacy practices, or tracking technologies (such as cookies) used on external platforms linked to our services.

4) Limitation of liability for damages

To the maximum extent permitted by law, Evervent Pvt Ltd and its directors shall not be held liable for any direct, indirect, punitive, incidental, special, or consequential damages, including but not limited to:

• Data & business loss: Loss of data or business opportunities arising from the use or inability to use the platform.
• Service defects: Damages resulting from defects, errors, or interruptions in service provision.
• User-initiated transactions: Transactions or financial decisions carried out based on instructions provided by the user.
• Consequential losses: Consequential losses, even if Evervent has been previously notified of the potential for such damages.

5) Data retention and account termination

• Data loss upon deletion: Once a subscription is terminated or an account is deleted, Evervent will securely remove personal data in accordance with our policy. We disclaim any liability for damages or data unavailability arising from such deletions.
• External data loss: We cannot be held responsible for data loss resulting from external circumstances or actions taken by third-party hosting providers.

6) Regulatory compliance and changes

• Legal jurisdiction: Any disputes arising from the use of Evervent products or policies are subject to the exclusive jurisdiction of the Courts in Chandigarh, India, and governed by the laws of the Republic of India.
• Policy updates: Evervent reserves the right to modify its Terms of Service and Privacy Policy periodically. We are not responsible for any confusion resulting from these updates and encourage users to review policies regularly.
